The bill on differentiated autonomy is a provision that defines the legislative and administrative procedures necessary to reach an agreement between the State and the Regions that require greater competences in certain matters. Here is a summary of the main points of the bill:
Purpose of the measure
It includes the procedural methods for the approval of agreements between the State and the individual Regions, as provided for by the same third paragraph.
The assignment of functions relating to these particular forms and conditions of autonomy, concerning matters or areas relating to civil and social rights that must be guaranteed throughout the national territory, is permitted only subject to the determination of the Essential Performance Levels (LEP) envisaged by the Constitution, which concern all the Regions of the country.
Procedure for the agreement
To reach an agreement, a legislative decree proposed by the Prime Minister and the Minister for Regional Affairs is required, in concert with the ministers responsible for the requested matters.
The procedure for the agreement must last at least 5 months, including the 60 days granted to the Chambers for examining the requests.
This bill is an instrument that undermines the unity of the country. Dangerous tool to definitively divide the central state from the regions. It outlines the procedures for the assignment of further forms and particular conditions of autonomy, not content with the deleterious experience of healthcare, destroyed and subjected to the "businessmen" and corruptors friends of the complacent administrators.
The law requires the State to define the Essential Performance Levels (LEP), which represent the minimum level of services to be guaranteed uniformly throughout the national territory, in order to avoid substantial differences between the various Regions in the provision of services and performance.
To avoid economic imbalances between the Regions that choose autonomy and those that do not, the bill provides equalization mechanisms. An amendment presented by Fratelli d'Italia and approved provides that even the Regions that do not request the transfer of competences will be transferred resources equal to those of the Regions that do request it. However, this must happen consistently with the planned public finance objectives and budget balances.
The opposition denounces that this clause effectively represents a "spending invariance", highlighting the lack of economic guarantees in the bill which could lead to divisions in the country. It is feared that the law on LEP risks being unworkable, since considerable financial resources may be needed to guarantee similar resources to all Regions and reduce the gaps between territories.
To be "clear", the concept of "Differentiated Autonomy" represents a government initiative bill wanted by the Minister for Regional Affairs and Autonomies, Roberto Calderoli. This text was discussed during the last legislature, undergoing variations during the discussions, especially following the changes in the governing majority with the Conte 2 and Mario Draghi governments.
The current text under vote returns to the original version, implementing the autonomy of the Regions with ordinary statute, as provided for in Article 116 of the Constitution, amended in 2001 with the support of the centre-left. Regions with ordinary statute that request it will be able to obtain management autonomy on a maximum of 23 subjects, which include, among others, health, education, energy and workplace safety. This means that these Regions will be able to have greater control and responsibility over these areas without having to depend directly on the decisions of the central government.

The Constitutional Affairs commission of the Senate, chaired by Alberto Balboni , simultaneously approved an amendment requested by the Brothers of Italy , which provides that resources be allocated to guarantee the Essential Performance Levels (LEP) to the Regions that do not require autonomy . Currently, there is a risk that economically stronger regions could acquire core competences, such as healthcare and related taxes, from the state budget, leaving few resources for regions that retain national competences.
The amendment aimed to rebalance this risk , but at the request of Minister Giancarlo Giorgetti it was added that the financing will be disbursed "with national budget invariance", i.e. without generating new expenses. This raises questions about how these possible resource alignments will be financed, as it is unclear where such funds will be drawn from without increasing the national deficit or creating additional burdens on the public budget.
Furthermore; the former president of the Consulta, Ugo De Siervo, raised a further problem regarding differentiated autonomy. He explained that it is not clear whether the Regions will be able to enact specific laws to regulate the matters subject to devolution. He underlined that if greater powers are granted to a Region in matters of health, it should be able to adopt its own legislation in that sector. However, if the Region adopts a specific law, it could modify the entire national legislation, unless it fragments the entire Italian regional system.
According to the constitutionalist, it would be necessary to intervene on the Constitution to truly implement the federalism desired by the League, or abandon the project altogether. The Democratic Party (PD) has announced its intention to propose a referendum to repeal the law, probably already during today's discussion. However, the time for a possible repeal will certainly be long.
